Welcome to Divaera! By signing up, login for a Divaera Account or by using any Divaera Services (as defined below) even if you visiting and come as a visitor, you are agreeing to be bound by the following terms and conditions (the “Terms and conditions”).
As used in these Terms of Service, “we”, “us”, “our” and “Divaera” means the applicable Divaera Contracting Party (as defined in Section 13 below), and “you” means the Divaera User (if registering for or using a Divaera Service as an individual), or the business employing the Divaera User (if registering for or using a Divaera Service as a business) and any of its affiliates.
Divaera provides a variety of digital products like After Effects, Premium Pro Project file Videos, Edits , Reel, Shorts, Animation, Logo animation, design , Intro, outro etc that are made in editing software. Photoshop PSD Of Thumbnail, Logo, Poster Overlay, Png, Gfx etc. Blender 3D Project File of models, Texture, Environment, 3D Seen etc . Along with the special pack or bundle of 3D renders, reels templete etc all free + Paid items. Rather than we also pprowide wordpress file, Pdf, Photo etc. We Provide comprehensive multi-vendor platform that empowers users to create, customize, and manage their digital products marketplace. Remember: the owner of the Ustore vendor is responsible for their product we are not responsible for any inconvenience by the vendor. You have to contact to the owner of the Ustore. By using the Divaera you have to agree the terms made by us not any term from the vendor Ustore owner in our site.This platform includes various tools for vendors to showcase and sell their products, interact with customers, and participate in the affiliate program. Any such service or services offered by Divaera are referred to in these Terms and Conditions as the “Conditions(c)”. Any new features or tools added to the current Services will also be subject to the Terms and condition. You must read, agree with and accept all of the terms and conditions contained or expressly referenced in these Terms of Service, including Divaera’s Acceptable Use Policy (“AUP”) and Privacy Policy, before you may sign up for a Divaera Account or use any Divaera Service. Additionally, if you participate in the affiliate program or offer goods or services related to certain categories, you must read, acknowledge, and agree to the applicable rules and policies.

Everyday language summaries are provided for convenience only and appear in bold near each section, but these summaries are not legally binding. Please read the Terms of Service, including any document referred to in these Terms of Service, for the complete picture of your legal requirements. By using Divaera or any Divaera services, you are agreeing to these terms. Be sure to occasionally check back for updates.

You are responsible for your Account, the Materials you upload to the Divaera Service and the operation of your Divaera Store. If you violate Divaera terms of service we may cancel your service access. If we need to reach you, we will communicate via the Primary Email Address.

1.1 Account Registration: To access and utilize our services, you must register for a Divaera account. During the registration process, you are required to provide accurate and complete information, including your full legal name, business address, phone number, a valid email address, and any other details indicated as mandatory. Divaera reserves the right to reject any account application or cancel an existing account at our discretion.

1.2 Age Requirement: You must be at least 18 years old or the age of majority in your jurisdiction to open an account on Divaera and use our services for business purposes.

1.3 Business Use: By using our services, you confirm that you are engaging in business activities and not for personal, household, or family purposes.

1.4 Primary Email Address: You acknowledge that Divaera will use the email address provided during account registration (or updated by you) as the primary method of communication. It is your responsibility to ensure that your primary email address is accurate and capable of sending and receiving messages. All communications from Divaera will be authenticated if they originate from your primary email address.

1.5 Password Security: You are responsible for maintaining the security of your account password. Divaera shall not be liable for any loss or damage resulting from your failure to safeguard your account credentials. We may request additional security measures and reserve the right to modify these requirements at our discretion.

1.6 Technical Support: Technical support for our services is available exclusively to Divaera users. Any inquiries regarding the Terms of Service should be directed to Divaera Support.

1.7 Prohibited Actions: You agree not to reproduce, duplicate, sell, resell, or exploit any part of our services without express written permission from Divaera. Furthermore, you shall not circumvent any technical limitations of our services, including but not limited to processing orders outside of Divaera’s checkout system, enabling disabled features, or reverse engineering our platform. Automated access to our services, such as through robots or scrapers, is strictly prohibited.

1.8 Data Transmission: You understand and acknowledge that your materials may be transferred unencrypted over various networks and may undergo adaptations to conform to technical requirements. “Materials” include your trademarks, copyrighted content, products or services sold through Divaera, and any other data provided by you or your affiliates to Divaera.

1.9 You have to provide the exact same information: while billing, such as the same email address that you use in Google Drive, because we have to register that particular email for downloading your purchased item in Google Drive. Therefore, remember to fill in the same email address in both the billing and Google Drive sections. Login information can be associated with a different email, but not with the billing email. We reserve the right to determine the eligibility of the given email for the download link in Google Drive.

If we detect any suspicious activity in billing or find the use of temporary email addresses, we reserve the right to terminate your account.

2. Third Party Services

At Divaera, we offer access to third-party services and experts to enhance your experience and provide additional functionalities.

Divaera may, at its discretion, suggest, grant access to, or enable third-party software, applications (“Apps”), products, services, or website links (collectively referred to as “Third Party Services”) for your consideration or use. These Third Party Services are provided solely as a convenience, and any purchase, access, or use of such Third Party Services is a direct agreement between you and the respective third-party service provider (“Third Party Provider”). In addition to these Terms of Service, you agree to adhere to any additional service-specific terms that apply to the services you acquire from or are provided by Third Party Providers.

  • You have no obligation to redeem any Third Party Offer. However, if you choose to do so, then you will be buying the relevant product and/or service from the supplier and not from us.
  • The description of products and services forming part of a Third Party Offer published on our site, and any associated links, have been provided to us by the suppliers. While we have made reasonable efforts to check the accuracy of the descriptions, the suppliers are solely responsible for any representations contained in those descriptions. Further, we do not endorse or assume any responsibility for those products and services.
  • We want to emphasize that third-party services are utilized at your own risk. Divaera is not responsible for the performance or outcomes of these services. By choosing to use third-party services on the Divaera platform, you consent to the sharing of your data, including customer data, with these services. It’s advisable to seek advice before integrating third-party services into your operations.
  • From time to time, Divaera may recommend, provide access to, or enable third-party software, applications, products, services, or website links (collectively referred to as “Third Party Services”) for your consideration or use. These Third Party Services are provided as a convenience, and your interaction with them is solely between you and the respective third-party service provider.
  • Divaera does not provide any warranties or representations regarding Third Party Services. We acknowledge that we have no control over Third Party Services and will not be responsible or liable for any issues arising from their use.
  • If you choose to install or enable a Third Party Service for use with Divaera’s services, you grant us permission to allow the relevant third-party provider to access your data and other materials. Any exchange of data or interaction between you and the third-party provider is solely between you and them.

  • Limitation of Liability:

    Under no circumstances will Divaera be liable for any damages resulting from your use of Third Party Services or your relationship with a Third Party Provider, including any Expert. These limitations apply even if Divaera has been advised of the possibility of such damages.

    • Indemnification:

      You agree to indemnify and hold Divaera, its parent, subsidiaries, affiliates, partners, officers, directors, agents, employees, and suppliers harmless from any claims arising from your use of a Third Party Service or your relationship with a Third Party Provider.

What We Own:

We exclusively own all the digital content available on Divaera, which includes the design, arrangement, and overall appearance of the website, along with the associated copyrights, trademarks, designs, and other intellectual property. This ownership extends to all trademarks, logos, service marks, and trade names present on Divaera, unless explicitly stated otherwise and excluding any properties owned by third parties. You are prohibited from copying, distributing, modifying, or creating derivative works of any content owned by Divaera or utilizing our intellectual property in any unauthorized manner as not expressly permitted within these terms.

Copyright, Trademark, and Intellectual Property Claims: We uphold the intellectual property rights of others and encourage reporting of any potential infringement. If you believe that any content on Divaera violates intellectual property rights, including copyright, please refer to our Intellectual Property Policy for guidance on reporting such instances.

Our Use of Your Information: Privacy is a priority for us, and we handle your information in accordance with our Privacy Policy. By using Divaera, you agree to the terms outlined in our Privacy Policy regarding the processing of your information.

Playing Fair: Your use of Divaera, its content, and the items available must comply with our policies, including the Acceptable Use Policy and the Fair Use Policy, as published on the Divaera website and outlined in our Help Center.

Linking; Apps Made by Others: We reserve the right to request the discontinuation of any links to Divaera and revoke your ability to link to our platform. Divaera may contain links to non-Divaera sites, over which we have no control or responsibility. We do not endorse or sponsor these sites, even if they are affiliated with us.

Affiliate Program

Divaera hosts an affiliate program. This program enables individuals to earn commissions by promoting products available on our platform. Affiliates can earn a percentage of sales generated through their referral links, providing an opportunity to monetize their online presence and marketing efforts. The commission percentage can be changed from time to time by Divaera, and users cannot make any objection about this. The payments of commission will be first verified and then transferred to your selected or requested payment options within 7 business days after withdrawal. False traffic or fake buying is strictly prohibited. We will take strict action of account termination and permanent ban from the website. Divaera has the authority to approve or reject payment requests, create or delete your account.

Sellers Quality Store

We have the authority to approve or reject the request to add your product to our store. We reserve the rights to delete or approve the product in Ustore. If we find any suspicious activity, we have the right to terminate your vendor account. Your payment can be delayed due to busy business days for up to 5 days. People can see and buy your product through our gateway with a minimum commission of 9% for the website. The commission rates can be changed by us (Divaera) at any time and in any region or zone. Product images should be in 2560×423 resolution; other resolutions will be directly rejected or cropped by us. The profile image of your Ustore should be in 1000×1000 resolution.

• Some main Sellers rules mentioned here:

  1. We Just Want the Quality Of the Product. We will take care all the things. If Your product is worth it.
  2. If Your Product is Aproved it will display in your Sellers Dashboard as Online in Products Tab.
  3. You can make small changes after the aproval of your Product.
  4. Don,t Upload Reused or Copiright Product that you not Own.
  5. After Approval Your Product will Display on the Main Shop.
  6. We will Inform you abot your product via email.
  7. All Products of Any plan chosen will be on Pending Reviewing for security purpose.
  8. Only 25% Commission Cut Off only in free plan as a Site Commission. Lower Cut offs in other plans.

    • Withdrawal Rules:

      1. All the payments account updated can be display after some time.
      2. Please Fill All Details correctly. Otherwise oreder will be canceled. We will inform you throughout email and last payment section. Whats wrong with your derails.
      3. After withdrawal cancelation your money will be back to your account. You can again request for withdrawal after correcting your payment account details inform you throught email.
      4. You payment settlement will be completed under 2 days after the request for withdrawal.

      5. Minimum Withdrawal limit is 900 for now.

    • Sellers Subscription Rules:

      1. None of the following plan allows you to direct upload your product. Only Your Quality Products are Aproved here.
      2. All the products you have uploaded is automatically deleted. When you apply for 30 money back request.
      3. Your earnings will still yours after applying the 30 days money back policy. Nothing will be deducted.
      4. You have to applying under 30 days for money Back of the plans.
      5. You can Apply for Money back for plans only in our Contact Us page showing in down side in the Footer.

Payments

  • Upon payment, your information will be received by us for verification.
  • We aim to deliver your item within 24 hours to your provided email and Download section, but it may take up to 5 business days.
  • Any suspicious activity or fraudulent payments will result in strict action, including potential termination of your account.
  • It is crucial that your payment information is accurate for instant delivery of your product.
  • Payments once made are non-refundable.
  • Ensure that you log in and provide correct billing details, which should be kept private for verification purposes only.
  • We reserve the right to take action if incorrect details are provided.
  • We utilize various payment gateways, such as UPI, PayPal, etc., exclusively for your convenience.
  • Your payment details should be kept private and secure through official payment gateways. We are not responsible for safeguarding confidential payment details, as this responsibility lies directly with the official payment gateways. Our role is limited to verifying payment information, such as the provided UPI ID, to confirm the transaction’s validity.

PayPal Express Checkout and Divaera Payments Accounts You acknowledge that PayPal Express Checkout and/or Divaera Payments will be your default payments gateway(s) and that it is your sole responsibility as the Store Owner to activate and maintain these accounts. If you do not wish to keep either of the payment accounts active, it is your responsibility to deactivate them. For the avoidance of doubt, PayPal Express Checkout is a Third Party Service, as defined in Third Party Service area.

Pricing

Geographical Pricing: The price of your Divaera digital products may vary depending on your country of residence. We may offer special plans, prices, or offers limited to specific geographical areas or for a limited time. Eligibility for such offers is determined at our sole discretion based on various factors, including geographic location. We reserve the right to adjust all Digital Products in Divaera website pricing based on your eligibility for specific plans, prices, or offers.

 

Changes to Prices: We have the right to modify our digital products and Ustore vendor user Product  pricing at any time and for any region.

Divaera Content: all the content that we have put on Divaera and includes the design, compilation, and look and feel of Divaera, and copyright, trademarks, designs and other intellectual property on Divaera (unless otherwise stated and excluding content owned by others like author content)

 

Items: digital goods found on Divaera, which may (but won’t necessarily) include goods like graphic design templates, fonts, WordPress themes, background music, After Effects project files, photography and much, much more.

Payment method: Any payment agent or method we make available on Divaera.

By creating an account on Divaera or visiting our account , you agree to comply with these terms and conditions.
